This contains important information concerning participation by you and all members of your party and accordingly (and by proceeding to payment), you acknowledge and agree that you shall ensure that all members of your party have read and accept the ‘Terms’.
· You confirm that all the following statements are true and accurate;
o I am in good general health, and physically & mentally capable of riding the e-bike on my choice of tour.
o I have no prior injuries, serious illnesses nor medical conditions which would preclude me from taking part in this guided e-bike tour.
o I have NEVER been advised by a medical professional to NOT participate in cycling activities
o I am not pregnant and have not given birth in the last six weeks.
o If I require medication for any medical conditions I have, it is my responsibility to carry these with me if deemed necessary to be able to take part in the guided e-bike tour
o I am not under the influence of alcohol, drugs or strong medications which may impair my ability to take part in a guided e-bike.
o I accept full responsibility for advising the Cycle About tour guide of any allergies that are relevant to my safe participation of my chosen tour.
2. Conditions of Use of an electric bicycle (from now on referred to as an e-bike)
o Whilst using the e-bike, I am fully responsible for my actions and I will NOT attempt any manoeuvres beyond my skill level or the bike’s capabilities as explained in the safety briefing prior to the start of the tour and during which I will have had the opportunity to familiarise myself with how the bike operates.
o Whilst using the e-bike, I agree to wear a helmet at all times (which meets the European safety standard EN 1078 for adults and EN 1080 for children) or borrow an approved helmet from CYCLE ABOUT as part of the e-bike hire.
o I will always follow the highway code.
o I will be courteous to pedestrians and other road users.
o I will always cycle respectfully when passing through farm land where I may be close to animals, machinery & buildings.
o I acknowledge that Cycle About tour guide reserves the right to remove me from the tour if I behave in a way considered dangerous to myself, others on the tour and members of the public. (Under these circumstances no refund will be given for either the tour or any equipment hired).
3. Media Use – Photography and Video
· Cycle About may take photographs and video recordings during courses for marketing, promotional, and social media use.
Please read these ‘Terms and Conditions’ before proceeding to making a payment with Cycle About E-Bike Tours. The terms contain important information concerning participation by you and members of your party and accordingly (and by proceeding to payment), you acknowledge and agree that you shall ensure that all members of your party have read and accept these ‘Terms and Conditions’.
1. Bookings and Payment.
i. All bookings are subject to availability. Once we confirm acceptance of your booking, full payment is required to be paid within 7 days of receipt of invoice. This can be done either via bank transfer or the website.
ii. A booking is not considered confirmed until the full balance is received, unless otherwise stated in writing by Cycle About.
2. Acknowledgement of Risk
Assumption of Risk:
i. By booking and participating in a Cycle About guided e-bike tour, you acknowledge that cycling carries inherent risks and agree it is ultimately your responsibility to ensure your own safety, to behave responsibly and within your own capabilities. You also accept that you engage in these activities entirely at your own risk.
ii. Whilst Cycle About will make every effort to ensure the safety of all individuals and minimise risk by pro-actively assessing and managing it in all its activities, you acknowledge and accept that risks cannot be entirely eliminated.
iii. You confirm that all riders are competent cyclists and physically able to ride an e-bike safely.
Indemnity:
i. You (the participants) agree to specifically release and forever discharge Cycle About from any and all liability or claims for injury, illness or death and for loss of or damage to personal belongings and property which you may suffer as a result of participating in one of our guided e-bike tours.
3. Cancellations
Cancellations by Cycle About:
Cycle About reserves the right to cancel or reschedule activities in the event of adverse weather conditions (excessive wind, storms or cold/heat), illness or guide availability or any other unforeseen circumstances beyond our control. In such cases, we will offer:
i. An alternative date*, or
ii. A full refund, if you choose not to reschedule
*Unfortunately, in these circumstances we cannot compensate for the cost of travel or accommodation in connection with the guided e-bike tour you have booked through us.
Cancellations by Participants.
If you cancel your booking and an alternative date cannot be arranged, the following refund structure applies:
· More than 28 days before the tour date: Full refund minus 10% admin fee of total booking price.
· 8 –28 days before the tour date: 50% of the total tour price refunded minus 10% admin fee of total booking price.
· 7 days or fewer: No refund will be given.
4. Safety
All participants start their tour with a safety briefing and test ride giving each rider an opportunity to familiarise themselves with how the e-bike operates. All participants are required to participate in the pre-tour briefing and are expected be able to cycle safely on public roads and be able to follow the Highway Code.
5. Agreement
By completing your booking either as a paid invoice or paying on the website, you confirm that you (and all members of your party):
· Have read and understood these Business Terms and Conditions.
· Accept the risks associated with participating in a guided e-bike tour.
· Agree to provide accurate personal and medical information as defined in our Terms of Participation policy (above).
· Will comply with all safety instructions provided by Cycle About guides.
